- "Ride" means a transportation arrangement between a Customer and a Captain, concluded directly between them.

3. BookKaro Is a Software Directory — Critical Disclaimer
BookKaro is a software directory and technology platform only. We provide a digital listing where independent Vehicle Owners ("Captains") can make their vehicles discoverable to Customers. You expressly acknowledge and agree that:
- We do not own any vehicles listed on the Platform.
- We do not employ, engage, supervise, or control any Captains or drivers. Captains are independent third parties acting for their own account.
- We do not provide transportation services of any kind. We are not a transport operator, taxi aggregator, common carrier, or travel agent.
- We do not dispatch or assign rides. Customers search for vehicles, view the Captain's details, and contact the Captain directly to negotiate and confirm a booking. There is no automated dispatch, assignment, or ride-allocation system.
- We do not set, calculate, or enforce fares. The Customer and the Captain mutually decide the price offline.
- We do not collect, hold, process, or route ride payments. All ride payments (Cash or UPI) are made directly by the Customer to the Captain. BookKaro is not a Payment Aggregator.
- We charge a fixed subscription fee only. Captains pay a subscription fee to be visible on the directory. The fee currently ranges from ₹99 to ₹299 per month, depending on the plan chosen, exclusive of applicable GST. BookKaro takes 0% commission on rides. Captains keep 100% of their earnings.
- The contract of carriage for any ride is solely between the Customer and the Captain. BookKaro is not a party to that contract and bears no liability arising from it.
4. Eligibility and Account Registration
- You must be at least 18 years of age and legally competent to contract to use the Platform.
- You must register an account using a valid mobile number and complete OTP verification.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You must notify us immediately at grievance@bookkaro.co.in of any unauthorized use of your account.
- We may refuse registration or suspend accounts at our discretion where we suspect fraud, misrepresentation, or violation of these Terms.
- One person may not maintain multiple accounts for fraudulent purposes.
- You must not create an account on behalf of another person without their consent.
5. Customer Terms
As a Customer using the Platform, you agree that:
- Accurate Information: You will provide accurate contact information and use the Platform only to discover and contact Captains.
- Direct Payment: You will negotiate and pay the Captain directly in Cash or UPI. BookKaro does not intervene in fare determination, does not set fares, and does not guarantee any fare.
- Verification Responsibility: You are solely responsible for verifying the identity of the Captain, the registration number of the vehicle, and the vehicle's condition before boarding. You should confirm the Captain's details through the app before the ride.
- No Guarantee: BookKaro does not guarantee the availability, punctuality, conduct, quality, or safety of any Captain or vehicle. Any dispute regarding a ride — including fare, route, delay, damage, or misconduct — must be raised directly with the Captain and, where appropriate, reported to BookKaro Support.
- No Refunds for Rides: If you have paid a Captain via UPI and the Captain fails to show up or fails to complete the ride, BookKaro cannot refund that money, as BookKaro never received it. You must contact BookKaro Support at grievance@bookkaro.co.in. We will investigate and may ban the Captain's account and assist in connecting you with the vehicle owner. Recovery of the paid amount remains a matter between you and the Captain.
- Respectful Conduct: You will treat Captains with respect and will not harass, threaten, discriminate against, or abuse them.
- Compliance: You will comply with the Acceptable Use Policy and Community Guidelines at all times.
- Lawful Use: You will not request any unlawful, unsafe, or prohibited ride, including transportation of illegal goods or persons.
- Personal Safety: You are responsible for your own personal safety decisions, including whether to board a vehicle, and you use the Platform at your own risk.
- Cancellation: You may cancel a confirmed booking before pickup by informing the Captain via the app. No cancellation fee is charged by BookKaro.
6. Captain (Vehicle Owner) Terms
As a Captain listing a vehicle on the Platform, you agree that:
- Ownership and Authority: You own or lawfully control the vehicle listed and have full authority to list it.
- Legal Compliance: The vehicle is duly registered, insured, and permitted for commercial use under the Motor Vehicles Act, 1988, and all applicable state rules. You will maintain all permits, fitness certificates, and insurance in force at all times.
- Genuine Documents: You will submit genuine documents — Registration Certificate (RC), Driving Licence (DL), Insurance, and Aadhaar — for verification. Submission of fake, altered, borrowed, or expired documents is grounds for immediate termination and may be reported to law enforcement.
- 100% Earnings: You will keep 100% of your ride earnings. BookKaro takes 0% commission on rides.
- Subscription Fee: You will pay a subscription fee to list your vehicle. The fee currently ranges from ₹99 to ₹299 per month, depending on the plan chosen, exclusive of applicable GST, or as per the then-current plan prices listed on the Platform:
- On the Website: payments are processed via Razorpay. A 30-day money-back guarantee applies to first-time subscribers only. After 30 days, fees are non-refundable.
- On the Android App: payments are processed via Google Play Billing (In-App Purchases). Standard Google Play refund policies apply (typically within 48 hours).
- Independent Contractor: You are an independent contractor, not an employee, agent, partner, or franchisee of BookKaro. You are solely responsible for your own taxes (including GST where applicable), permits, insurance, and compliance with all applicable laws.
- Professional Conduct: You will behave professionally, honour confirmed bookings in good faith, and not engage in overcharging, harassment, or misconduct.
- No Circumvention: You will not solicit Customers to deal off-platform in a manner that circumvents Platform safety, verification, or communication features.
- Document Updates: You will promptly update expired documents. BookKaro may suspend or terminate your listing for document expiry, safety complaints, fraud, or policy violation.
- Fitness to Drive: You will not use the Platform while under the influence of alcohol or drugs, and will not carry unauthorized passengers or goods.
- Vehicle Condition: You will maintain your vehicle in roadworthy condition and comply with all safety requirements.
- Insurance: You will maintain valid commercial insurance covering passengers and third parties at all times.
7. Subscription Plans, Auto-Renewal, and Cancellation
- Subscription Plans: BookKaro offers multiple subscription plans for Captains. The current plans and their prices (exclusive of applicable GST) are listed on the Pricing page at www.bookkaro.co.in/pricing.html. Prices currently range from ₹99 to ₹299 per month (monthly billing) or the corresponding yearly amounts, depending on the plan chosen.
- GST: All prices are exclusive of applicable GST (currently 18% for these services). GST is added at checkout and shown on your invoice.
- Payment Processing:
- Website purchases are processed by Razorpay. By purchasing, you also agree to Razorpay's terms of service.
- Android App purchases are processed by Google Play Billing. By purchasing, you also agree to Google Play's terms of service.
- Auto-renewal: Subscriptions may auto-renew at the end of each billing period unless cancelled before the renewal date.
- How to cancel:
- Website subscriptions: Manage via your account dashboard or by writing to grievance@bookkaro.co.in before the renewal date.
- App subscriptions: Cancel via Google Play Store → Payments & subscriptions → Subscriptions, before the renewal date.
- Cancellation stops future renewals but does not automatically refund the current period, except as stated in the Refund & Cancellation Policy.
- We may change subscription fees from time to time. Changes will not affect an already-paid subscription period. The current plans and prices are always displayed on the Pricing page.
- Failure to pay subscription fees may result in suspension of your listing.
8. Verification Disclaimer
BookKaro performs reasonable verification of Captain documents (RC, DL, Insurance, Aadhaar). This verification is a good-faith check only and does not constitute a guarantee of the Captain's conduct, character, vehicle roadworthiness, or ongoing document validity. Customers must exercise their own judgment and diligence. BookKaro is not liable for any loss arising from reliance on such verification.
9. Communication Features and Records

- BookKaro may review communication records in response to complaints or legal requests.
- BookKaro is not obligated to monitor communications but may do so where safety or legal concerns arise.

You may request deletion of your account and associated personal data at any time by:
- Using the "Delete Account" option in the App or Website (see delete-account.html).
- Writing to grievance@bookkaro.co.in with your registered mobile number.
Upon a valid deletion request, we will delete or anonymize your account data within 30 days, subject to legal retention obligations (e.g., subscription records for tax purposes, KYC documents for regulatory compliance, chat/call logs for safety investigations). See our Privacy Policy for retention periods.
15. Limitation of Liability
To the maximum extent permitted by applicable law, BookKaro, its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from: (a) any ride or the conduct of any Customer or Captain; (b) any fare or payment dispute; (c) any off-platform interaction; (d) any interruption, error, or unavailability of the Platform; (e) any reliance on verification; or (f) any loss of data or profits. The Platform is provided on an "as is" and "as available" basis. Our total aggregate liability, if any, shall not exceed the subscription fees paid by you in the three (3) months preceding the claim.
