Important: This is a position statement, not a legal opinion or a claim of exemption. Whether BookKaro is classified as an "aggregator" under the Motor Vehicles Act, 1988, or the Jharkhand On-Demand Transportation Technology Aggregator Rules, 2019, is a matter for the competent authority to determine based on the facts of its operations. BookKaro's position is that it does not meet the defining characteristics of an aggregator, as explained below.

1. BookKaro's Position

BookKaro operates as a software directory that makes independent Vehicle Owners ("Captains") discoverable to Customers. BookKaro does not:

Own vehicles.
Employ drivers.
Dispatch or assign rides to specific drivers.
Set, calculate, or enforce fares.
Collect, hold, or process ride payments.

BookKaro charges Captains a fixed subscription fee for listing visibility. The fee currently ranges from ₹99 to ₹299 per month depending on the plan chosen (exclusive of applicable GST), as listed on the Pricing page at www.bookkaro.co.in/pricing.html. BookKaro takes 0% commission on rides.

2. Why BookKaro Is Not an Aggregator

Under the Jharkhand ODTTA Rules 2019, a licensed aggregator is required to publish a fare policy with reference to state-specified minimum and maximum rates, maintain driver and vehicle records, and comply with extensive operational conditions. BookKaro's model differs materially:

2.1 No Dispatch

Customers search for vehicles and contact Captains directly. BookKaro does not match, assign, or allocate rides. There is no automated dispatch, assignment, or ride-allocation system.

2.2 No Fare-Setting

The Platform does not compute, display, or mandate any fare. The Customer and Captain mutually decide the price offline. BookKaro does not publish a fare policy, minimum fare, maximum fare, or surge pricing.

2.3 No Payment Collection

All ride payments are settled directly between Customer and Captain. BookKaro does not touch ride money and is not a Payment Aggregator.

2.4 Subscription-Only Revenue

BookKaro's only revenue from Captains is a fixed listing fee, ranging from ₹99 to ₹299 per month depending on the plan. It takes no commission on rides. Captains keep 100% of their earnings.

4. Independent Captains

All Captains are independent third parties. They are solely responsible for:

Obtaining and maintaining all required permits under the Motor Vehicles Act, 1988.
Maintaining valid fitness certificates, insurance, and pollution certificates.
Complying with all applicable state transport rules.
Their own taxes.

5. Regulatory Compliance

BookKaro intends to comply with all applicable laws. Where any competent authority determines that BookKaro's model requires a licence or registration, BookKaro will assess its obligations and take appropriate steps. Nothing in this statement waives, limits, or evades any statutory obligation.

6. No Waiver of Statutory Rights

Nothing in this statement limits the rights of any User under the Consumer Protection Act, 2019, the Motor Vehicles Act, 1988, or any other applicable law.
