1. BookKaro Is a Software Directory Only
BookKaro is a software directory and technology platform. We provide a digital listing that allows Customers to discover and contact independent Vehicle Owners ("Captains"). We are not a transport company, taxi operator, common carrier, or travel agent. We do not own vehicles, employ drivers, or provide transportation services of any kind.
2. No Transportation Services Provided
All transportation services are provided solely by independent Captains, who act for their own account and at their own risk. BookKaro is not a party to any ride, booking, or contract of carriage between a Customer and a Captain. Any dispute regarding a ride — including fare, route, delay, damage, injury, or misconduct — must be resolved directly between the Customer and the Captain.
3. No Dispatch, No Fare-Setting, No Payment Collection
BookKaro does not:
- Dispatch or assign rides: Customers search for vehicles and contact Captains directly. BookKaro does not match, assign, or allocate rides.
- Set, calculate, or enforce fares: The Platform does not compute, display, or mandate any fare. The Customer and Captain mutually decide the price offline.
- Collect, hold, or process ride payments: All ride payments are settled directly between Customer and Captain (Cash/UPI). BookKaro does not touch ride money.
4. No Guarantee of Availability, Quality, or Safety
The Platform is provided on an "as is" and "as available" basis. BookKaro makes no representation or warranty regarding:
- The availability of vehicles or Captains at any time or location.
- The quality, safety, roadworthiness, or condition of any vehicle.
- The conduct, character, punctuality, or reliability of any Captain or Customer.
- The accuracy of any information provided by Users.
- The uninterrupted or error-free operation of the Platform.
You use the Platform and engage with other Users entirely at your own risk.
5. Verification Is Not a Guarantee
BookKaro performs reasonable verification of Captain documents (RC, DL, Insurance, Aadhaar). This is a good-faith check only. It does not constitute a guarantee that documents are genuine, current, or valid, or that the Captain is fit, competent, or safe. Customers must exercise their own judgment and verify the Captain and vehicle before boarding.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Axxoraa Private Limited, its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
- Your use of the Platform or any interaction with another User.
- Personal injury, property damage, or financial loss.
- Any ride or the conduct of any Customer or Captain.
- Any fare or payment dispute.
- Any off-platform interaction.
- Any reliance on verification.
Your sole remedy for dissatisfaction with the Platform is to stop using it.
7. Third-Party Links and Services
The Platform may contain links to third-party websites or services (e.g., Razorpay, Google Play, WhatsApp). BookKaro does not control and is not responsible for the content, policies, or practices of these third parties. Your use of third-party services is at your own risk and subject to their terms.
8. No Legal or Professional Advice
Nothing on the Platform constitutes legal, financial, tax, or professional advice. You should consult qualified professionals for advice specific to your situation.
9. Captain Responsibility
Captains are solely responsible for:
- Obtaining and maintaining all required permits under the Motor Vehicles Act, 1988.
- Maintaining valid fitness certificates, insurance, and pollution certificates.
- Complying with all applicable state transport rules.
- Their own taxes, including GST where applicable.
- Their conduct and the condition of their vehicles.
10. Customer Responsibility
Customers are solely responsible for:
- Verifying the Captain's identity and vehicle before boarding.
- Making their own safety decisions.
- Paying the agreed fare directly to the Captain.
- Complying with all applicable laws.
11. No Waiver of Statutory Rights
Nothing in this Disclaimer limits the rights of any User under the Consumer Protection Act, 2019, the Motor Vehicles Act, 1988, or any other applicable law. Users may approach appropriate authorities or forums for redressal.
